NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated November 4, 2009, and the Deed of Trust of even date securing the same, recorded November 18, 2009, at Book 74, Page 268 in Office of the Register of Deeds for Overton County, Tennessee, executed by Johnny Baer and Francis C. Baer,
conveying certain property therein described to Andrew C. Rambo, a resident of Shelbyville, Tennessee as Trustee for Mortgage Electronic Registration Systems, Inc, as nominee for First Community Mortgage, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on January 3, 2013 on or about 2:00 P.M., at the Overton County Courthouse, Livingston, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Overton County, Tennessee, and being more particularly described as follows:
Tract Number 1: The following described tract or parcel of land in the 6th Civil District of Overton County, Tennessee, to wit:
Beginning at an iron stake on the North margin of Highway 84, and the Southwest corner of Lot 16, of the Parkview Subdivision; thence Northwardly 46 degrees East 156 feet to an iron stake; thence Southwardly 30 degrees 30 minutes East 106 feet to a stake in the line of Lot 18, Conner’s property; thence Southwardly 47 degrees 30 minutes West 134 feet to the margin of Highway 84; thence Northwardly 42 degrees 30 minutes West 100 feet to the Point of Beginning, and being Lot Number 17, of the Parkview Subdivision.
Tract Number 2: The following described tract or parcel of land in the 6th Civil District of Overton County, Tennessee, to wit:
Beginning at an iron pin on the Northwest margin of Highway 84, corner of Lot 14, of the Parkview Subdivision; thence Northwardly 46 degrees East 198.5 feet to an iron pin; thence Southwardly 30 degrees 30 minutes East 205 feet to an iron pin; the corner of Lot Number 17 of the Parkview Subdivision; thence Southwardly 46 degrees West 156 feet to the margin of Highway 84; thence Northwardly 42 degrees 30 minutes West 200 feet with the margin of Highway 84, to the Point of Beginning, and being Lots Numbers 15 and 16, of the Parkview Subdivision.

The HB 3588 letter was mailed to the borrower(s) pursuant to Tennessee Code Annotated 35-5-117. This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
