SUBSTITUTE TRUSTEE’S SALE
Default having been made in the payments of debts and obligations to be paid in that certain Deed of Trust acknowledged on the 31st day of January, 2001, and was executed by Joe Lloyd Dishman and wife Helen Dishman, to Charles E. Ward, as Trustee, and recorded in the Register’s Office of Overton County, Tennessee, in Trust Deed Book 276, Page 131; the undersigned, Daryl A. Colson has been duly appointed by the holder of said indebtedness as Substitute Trustee on said Deed of Trust, said appointment being recorded in said Register’s Office in Record Book 137, Pages 211-213; and the holder of said indebtedness having requested the undersigned to advertise and sell the property described in and conveyed to said Deed of Trust, all of said indebtedness and obligations having matured by default, this is to give notice that Daryl A. Colson, as Substitute Trustee, will on the 8th day of September, 2014 commencing at 12:00 p.m. (or noon) at the Overton County Courthouse in Livingston, Overton County, Tennessee, on the North side of said Courthouse shall proceed to sell at public outcry to the highest and best bidder for cash the following described property (“Property”) situated and being in Overton County, Tennessee, to wit: Lying and being in the 2nd Civil District of Overton County, Tennessee and more particularly described as follows:
BEGINNING at an iron rod in the Eastern margin of R.T. Holman Lane; thence with the Northern and thence Eastern margin of said road the following calls: North 75 degrees 20 minutes 13 seconds West 17.89 feet to a wood post; North 78 degrees 52 minutes 12 seconds West 144.76 feet to an iron rod; North 77 degrees 12 minutes 55 seconds West 47.69 feet to an iron rod; North 67 degrees 36 minutes 02 seconds West 25.40 feet to an iron rod; North 42 degrees 25 minutes 47 seconds West 27.43 feet to an iron rod; North 09 degrees 41 minutes 39 seconds West 28.77 feet to an iron rod; North 08 degrees 57 minutes 17 seconds East 103.17 feet to an iron rod; North 09 degrees 27 minutes 41 seconds East 349.76 feet to an iron rod, being the place of beginning and containing 10.52 acres, more or less.
The lands herein described being a PORTION of those conveyed to John H. Webb and wife Sarah J. Webb and Ray Buford and wife Dean Buford from Carl Bowers and wife Thelma Bowers by Warranty Deed recorded in the Register’s Office of Overton County, Tennessee, in WD Book 290, page 61.
This description taken from a survey and plat by David A. Sells, RLS #1795, dated February 24, 2000, a reduced copy of which is attached to the previous and last conveyance, and being identified as Tract 4 in said plat. There are overhead power lines which cross this property and subject to any easements that may apply.
This description and survey subject to any and all rights-of-ways and/or easements, recorded or unrecorded, which may affect this property.
The previous and last conveyance being a deed of John H. Webb and wife Sarah J. Webb and Ray Buford and wife Dean Buford to Joe Lloyd Dishman and wife Helen Dishman, which deed is of record in the Register’s Office of Overton County, Tennessee, in WD Book 294, page 269.
FOR TAX PURPOSES, being the property identified as a Portion of as Tax Map 79, Parcel 4.00.
All rights and equity of redemption, homestead, dower and all other exemptions are expressly waived by the Debtor in said Deed of Trust and title is believed to be good, but I will sell and convey only as Substitute Trustee. Title is to be conveyed subject to all prior liens, easements, covenants, conditions, encumbrances, and restrictions that may exist including, without limitation, any unpaid taxes, or other taxes on said property, and also subject to any right to redemption that may otherwise exist, including such right by the Internal Revenue Service Special Procedures Staff.
THIS SALE SHALL BE MADE WITHOUT ANY WARRANTY, EITHER EXPRESS OR IMPLIED, AS TO TITLE, BY THE SUBSTITUTE TRUSTEE OR THE HOLDERS OF THE INDEBTEDNESS.
