NOTICE OF TRUSTEE’S SALE
WHEREAS, KATHY J. MABE and JESSIE COLT UKER, by a Deed of Trust dated November 21, 2005, of record in Record Book 8, Page 419, Register’s Office of Overton County, Tennessee, conveyed to Bryant C. Dunaway, Esq., Trustee; the hereinafter described real property to secure the payment of a certain Promissory Note (“Note”) described in the Deed of Trust, which note was payable to JOANNE IRWIN; and,
WHEREAS, default has been made in the terms and obligations under the Note and Deed of Trust; and,
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of said indebtedness and the cost of foreclosure, in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that I, Bryant C. Dunaway, Esq., Trustee, pursuant to the power, duty and authority vested in and conferred, by the Deed of Trust, will on the 1st day of April, 2014, at 11:00 a.m. o’clock, prevailing time, at the East door of the Overton County Court House, Courthouse Square, in Livingston, Tennessee, offer for sale to the highest and best bidder for cash, and free from all legal equitable and statutory rights of redemption, exemption of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property situated in Overton County, Tennessee, described as follows:
Located in the First Civil District of Overton County, Tennessee as follows:
Lot Number 2 of Thorn Gap Sub-division, as described on a plat recorded at the Register’s Office for Overton County, Tennessee. Plat recorded in Plat Book 1, page 101-A, and which is herein referred to for a more complete description of the above property.
For tax purposes, being the property identified as Tax Map 113, Parcel 11.09.
Included in this conveyance and permanently located on the above described property is the following manufactured home: 1989 IMPR, VIN#1CIIA2807.
The address of the above-described property is 151 Thorn Lane, Cookeville, TN 38506.
This sale is subject to all matters shown on any applicable recorded plats; any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter than an accurate survey of the premises might disclose.
