TRUSTEE’S NOTICE OF SALE
Default having been made in the payment of the debts and obligations secured to be paid by a certain deed of trust executed by Hilda Cox and Eugene Cox
on the 12th day of January, 2006, to Rusty Robbins, Trustee, as same appears of record in the Register’s Office of Overton County, Tennessee, in Book 10, page 715; and First National Bank of Tennessee being the owner and holder of the debt secured, having requested the undersigned to advertise and sell the property described in and conveyed by the said deed of trust, all of the said indebtedness having matured by default in the payment of a part thereof, this is to give notice that the undersigned will on October 2, 2013 commencing at 11:30 a.m., at the east door of the Overton County Courthouse, Livingston, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described tract of property, lying and being in the 3rd Civil District of Overton County, Tennessee, as follows:
Tract 1: Beginning at a sassafras tree and lying generally East of the Anna Bilbrey Dale residence; thence Southwardly generally parallel with the Turkey Town Ridge Road approximately 210 feet to a set stone; thence Eastwardly approximately 420 feet to a black gum; thence Northwardly approximately 210 feet to a set stone; thence Westwardly approximately 420 feet to the point of beginning, containing two (2) acres, more or less, and being a portion of the land conveyed to A.W. Dale and wife, Anna Bilbrey Dale from Lester Bennett and wife, Ova Gibbons Bennett by deed of record in Deed Book 90, page 109, Register’s Office, Overton County, Tennessee, to which reference is here had, and included in this conveyance is a right-of-way for purposes of ingress and egress along the lane running from the Turkey Town Ridge Road North of the Anna Bilbrey Dale residence and into a logging road which leads to the land herein described.
Further included in this conveyance are reasonable water rights to a well on other lands of the Grantor located near the aforementioned roadway and including with said water rights the privilege to lay and maintain electrical lines, pipelines, pumps, tanks, and other necessary facilities for the reasonable exercise of said rights.
Tract 2: North by the lands of A.W. Dale and A.P. Lynn; East by lands of Ben Carr and Bugett; South by Charlie Coffman (formerly Gibbons); and West by lands of A.P. Lynn, containing 31 acres, more or less, and excluding the parcel conveyed previously to Sharon Ashlock.
Also included is a 1985 16’ x 80’ Spiral mobile home, but holder of the debt does not have possession of the certificate of title.
The previous and last conveyance being a Trustee’s Deed from Jack Windle, Trustee, to Eugene Cox and wife Hilda Cox, which deed is of record in the Register’s Office of Overton County, Tennessee, in Record Book 7, page 129, and by Corrected Trustee’s Deed recorded at Record Book 9, page 928.
Per the records of the Assessor of Property, the street address of the above-described property is 438 Turkey Town Road, Hilham, Tennessee, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description referenced herein shall control. The Assessor’s records identify the property as Tax Map 32, Parcel 9.02.
Said sale shall be subject to any unpaid property taxes, to any additional prior, liens, leases, encumbrances, to any rights of redemption not heretofore expressly waived, and to all applicable reservation of minerals, easements, rights-of-way, setback lines and restrictions.
OTHER INTERESTED PARTIES: Tenant(s) rights in possession, if any.
The statutory right of redemption, the rights to homestead, curtesy and dower, appraisement, and the marshaling of liens and assets are waived in said deed of trust, and the title is believed to be good, but the undersigned will sell and convey only such title as he may convey as Trustee there being no representations or covenants of warranty of title made hereby.
It will be the responsibility of the successful bidder to obtain possession of the property at his expense, and any damage, vandalism, theft, destruction, or other loss or damage to the property occurring subsequent to the date of sale shall be at the risk of the successful bidder.
The Trustee reserves the right to postpone or set over the date of sale in the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement as deemed reasonable by the Trustee. In the event the highest bidder at such sale fails to complete his purchase of the subject real property within the applicable time allowed, the undersigned Trustee reserves the right to complete the sale of the subject real property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Trustee.
