NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated May 27, 2003, and the Deed of Trust of even date securing the same, recorded May 29, 2003, at Book 325, Page 605 in Office of the Register of Deeds for Overton County, Tennessee, executed by Larry A. Kaatz, Sr. and Laura M. Kaatz,
conveying certain property therein described to Arnold M. Weiss, Esq. as Trustee for Wells Fargo Home Mortgage, Inc.; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on July 18, 2013 on or about 2:00 P.M., at the Overton County Courthouse, Livingston, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Overton County, Tennessee, and being more particularly described as follows:
Located in the Second Civil District of Overton County and more particularly described as follows:
A tract or parcel of land situated in the Golden Pond Subdivision of Overton County, Tennessee, and being a portion of Tract 16 of said subdivision. Its perimeter is described as follows: Beginning at a point in the center of a 50 foot wide right of way easement, being the extreme North corner of this tract being described and the Northeast corner of the remainder of Tract 16; thence, with the West line of Tract 17 of said subdivision, South 17 degrees 06 minutes 00 seconds East, 599.81 feet to a point in the middle of a lake, being the extreme South corner of this tract being described and a common corner for eight tracts of said subdivision; thence leaving Tract 17 and running with the Northeast line of Tract 15, North 47 degrees 20 minutes 47 seconds West, 543.69 feet to a point in the center of the said right of way easement, being the extreme West corner of this tract being described and the Southeast corner for the remainder of Tract 16; thence with the center of the right of way easement and severing Tract 16, North 47 degrees 29 minutes 03 seconds East, 303.21 feet to the point of beginning, and containing 1.8855 acres.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
