NOTICE OF SALE
WHEREAS, by Deed of Trust dated October 5, 2006, of record at Record Book 24, pages 89-92, Register’s Office of Overton County, Tennessee, William L. Donaldson
conveyed in trust to Michael K. Bailey, Trustee, that property hereinafter described to secure the payment of a certain promissory note; and
WHEREAS, Bank of Celina, Branch of Citizens Bank of Lafayette, Celina, Tennessee, is presently the owner and holder of said Promissory Note and Deed of Trust above referred to, securing the indebtedness therein mentioned; and
WHEREAS, default has occurred under the terms of the Promissory Note and the Deed of Trust, thereby necessitating foreclosure, and Bank of Celina, Branch of Citizens Bank of Lafayette, Celina, Tennessee, has directed Michael K. Bailey, as Trustee, to immediately commence foreclosure on the subject property;
NOW THEREFORE this Trustee’s Notice of Sale, default having occurred in the payment of the Promissory Note according to the terms and conditions thereof, and the Promissory Note being in default, the undersigned, Michael K. Bailey, Trustee, does hereby give notice that he, as attorney, and/or agent, will sell the hereinafter described property on 7th day of March, 2013, at the hour of 1:00 p.m., at the East door of the Courthouse in Livingston, Overton County, Tennessee, to the last, highest and best bidder, for cash in hand and free from the rights of redemption, homestead, and dower, and all other exemptions of any kind, but subject to any delinquent or current real property taxes on the property, and any valid mineral and/or oil and gas leases. The property to be sold is described as follows, lying and being in the 12th Civil District of Overton County, Tennessee, and more particularly described as follows, to-wit:
BEGINNING at a metal post on the West side of the Hoover Cemetery Road across from the North Overton Utility District property; thence North 81-38-49 West 119.63 feet to a metal post; thence North 10-11-14 Eat 112.33 feet to a metal post on the South side of the Hoover Cemetery Road; thence with said Hoover cemetery Road; thence with said Hoover Cemetery road South 71-52-38 East 112.80 feet to a tree in a curve of said Hoover Cemetery Road South 5-21-43 West 93.26 feet to the point of BEGINNING, containing 0.272 acres, more or less.
EXCLUDED from this conveyance is a Clayton East Wind 14 x 56 mobile home, VIN TEN 45299, which has been sold and removed from property.
INCLUDED in this conveyance is a 1997 Fleetwood mobile home, VIN #TNFLT26A46715RL12 located on the premises.
And being the same lands conveyed to William L. Donaldson from W. A. Goney by warranty deed dated September 27, 2006, and recorded in Record Book 23, pages 796-797, Register’s Office of Overton County, Tennessee.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants; easements, or set back lines that may be applicable; any statutory rights or redemption of any Governmental Agency, State or Federal; any prior liens or encumbrances as well as any priority created by fixture filing; to any matter that an accurate survey of the premises might disclose; and subject to, but not limited to the following parties who may claim an interest in the above referenced property; Bank of Celina, Branch of Citizens Bank of Lafayette, Celina, Tennessee, William L. Donaldson, and subject to any party who may claim an interest in the above referenced property.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
If the highest bidder cannot pay the bid within twenty-four (24) hours of the sale, the next highest bidder at their highest bid, will be deemed the successful bidder.
This property is being sold with the express reservation that the sale is subject to confirmation by the lender or Trustee. This sale may be rescinded at any time.
